Terms of Use

§1. General provisions

  1. These Terms set out the rules for using the website at fahrwest.com (the "Website").
  2. The owner and operator of the Website is FAHRWEST LOGISTICS SP. Z O.O., with its registered office in Warsaw, ul. Żurawia 32 lok. 433/435, 00-515 Warsaw, Poland, NIP 5213945046, KRS 0000931105 (the "Provider").

  4. These Terms are made available free of charge in a form that allows them to be downloaded, stored and printed.

§2. Definitions

Website The fahrwest.com website together with its subpages
User A person using the Website
System The Fahrwest TMS software, available at tms.fahrwest.com
Form The contact form used to request a demonstration of the System

§3. Scope of services

  1. Through the Website, the Provider supplies the following services by electronic means, free of charge: a) making information about the System available, b) making available a Form for contacting the Provider.
  2. The Website does not provide access to the System. The rules for using the System, including payment terms, are set out in a separate agreement concluded with the customer.
  3. Information published on the Website does not constitute an offer within the meaning of Art. 66 § 1 of the Polish Civil Code, but an invitation to conclude an agreement.

§4. Technical requirements

Proper use of the Website requires:

  1. a device with Internet access,
  2. a current version of a web browser with JavaScript enabled,
  3. an active e-mail account — when using the Form.

§5. Rules of use

  1. The User is obliged to use the Website in accordance with the law and good practice.
  2. Supplying unlawful content is prohibited, in particular content infringing the personal rights of third parties, offensive content, and personal data of third parties provided without their consent.
  3. It is prohibited to take actions that disrupt the operation of the Website, including automated retrieval of content in a manner that places an unreasonable load on the infrastructure.
  4. The Provider may block access to the Website for a User in breach of paragraphs 2–3.

§6. Intellectual property

  1. Content published on the Website — texts, graphics, page layout and composition — is subject to the exclusive rights of the Provider and is protected by law.
  2. The FAHRWEST LOGISTICS designations, the logotype and the graphic marks are protected trade marks of the Provider. Their use without prior consent is not permitted.
  3. Use of the Website's content beyond permitted personal use requires the prior written consent of the Provider.

§7. Complaints

  1. Complaints regarding the operation of the Website may be submitted to [email protected].
  2. A complaint should contain a description of the problem and contact details enabling a response.
  3. The Provider examines complaints within 14 days of receipt.

§8. Personal data

The rules for processing Users' personal data are set out in the Privacy Policy, available on the Website.

§9. Final provisions

  1. The Provider reserves the right to amend these Terms. Amended Terms take effect on the date of their publication on the Website.
  2. Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code and the Act on Providing Services by Electronic Means.
  3. The Website is available in Polish, Ukrainian and English. In the event of any discrepancy between language versions, the Polish version prevails.
